In the Texas criminal justice system, children under age 10 cannot be prosecuted for a crime but they could be provided with services if the state feels that's needed to help them stay out of the juvenile justice system. 17-yr-olds facing charges for a crime committed beforethey turned 17 – a crime that would be defined as delinquent conduct or conduct indicating a need for supervision – are also charged in juvenile court. But after a child turns 17, they are now involved with the adult justice system. Texas is one of only three states that charge 17-year-olds as adults. The Texas Criminal Justice Coalition has been campaigning for a number of years to raise the ageat which a child can be tried as an adult to 18. House Bill 967and Senate Bill 1552, introduced in the 2021 legislative session, would have done just that. Unfortunately, the legislative session ended with no action taken.
