Their incapacity is written into the statute—hence the term, "statutory" rape. Like many other states, there's no "statutory rape" law in New York. Rather, these offenses are charged as sex offenses—including rape—depending on the sexual act and age of the parties. Forcible Rape and Assault Statutory rape does not require the prosecutor to prove an assault occurred. Rape that does involve force or an assault gets charged as forcible rape. Assaults of a sexual nature may also be charged under the state's assault and battery laws and child enticement and abuse laws.
